Construction Law

Gregory, Golden and Landeryou, LLC provides comprehensive services to those involved in all aspects of the Construction Industry. These services range from negotiation and drafting of contract documents, handling all aspects of mechanic’s lien work, and serving as trial counsel for all manner of claims arising from construction projects, including but not limited to, construction defect, delay, and payment claims.

We have been providing these services for construction projects throughout the state of Colorado for a wide range of projects from small to large single family homes, “spec” home projects, multifamily projects, and commercial projects. Our commercial project work has included office buildings, schools, restaurants, and governmental projects such as water treatment plants and work in and around state and national parks. We represent owners, including homeowner associations, general contractors, subcontractors, and design professionals to provide them with contracts reflecting practical risk allocation among those on a construction project, and in litigation where breaches of contractual obligations and/or tort duties should be or have been claimed.

We have extensive experience in representing parties involved in construction disputes in both state and federal courts as well as in private arbitrations and mediation. Additionally, the firm provides development and entitlement work related to projects that are in their conceptual or formative stages.

Contract Law

Contracts help to define the rights and obligations of the parties to an agreement. Contracts can be written or oral agreements. A well-drafted contract can assist you in properly allocating your risk in your written agreements with others. Conversely, a poorly written contract may create false expectations and fail to adequately protect you if a dispute arises. Homeowner Associations

Gregory Golden & Landeryou LLC has extensive experience in the areas of creating common interest communities and drafting declarations of covenants, conditions, and restrictions. We represent homeowners associations, owners and developers in the creation of common interest communities. We create condominium, townhome and planned development communities, including state registration and the drafting of declarations, bylaws, rules and regulations and policies and procedures. We assist with the restatement and amendment of existing community documents. We handle all documentation necessary for governance by a homeowner’s association. These include homeowner association declarations, restrictive covenants, rules and regulations, and a set of policies and procedures. We also represent numerous property owner associations, providing legal assistance through the HOA lien process to collect outstanding amounts owed. Eminent Domain/Condemnation

Eminent Domain proceedings affecting one’s property require an owner to understand his or her rights under both the United States and Colorado Constitutions and applicable law. Gregory, Golden and Landeryou, LLC is experienced in representing property owners of residential, farming/ranching properties, and commercial projects in all aspects of an eminent domain proceeding. We counsel and represent an owner’s interest from responding to an initial notice that their property is being threatened by a condemnation to pursuing the owner’s right to defend at trial the taking of their property where feasible. We aggressively seek “just compensation” at trial, a constitutional right of every property owner where their property is being taken by eminent domain. The firm has experience in representing clients in eminent domain proceedings commenced by cities, municipalities, utilities companies, the Colorado Department of Transportation, and with private ways of necessity between adjoining landowners.
